Policy provides $1,000,000 of coverage per Insured per occurrence and $3,000,000 per insured aggregate per year for protection against lawsuits. Defense costs are paid in addition to this amount.

Professional Liability Insurance protects you, as a school employee, in the event that a student or parent was to accuse you of such things as discrimination, injuries to students, non compliance with ADA guidelines, and more. NPEA’s policy also provides reimbursement for alleged criminal acts. This includes sexual misconduct coverage and the policy will provide up to $35,000 in reimbursement of attorney fees if not guilty or if the case is dismissed.

FAQ

Doesn’t My District or University Carry Insurance?

The school district or university must protect itself first. You as an employee of the entity should also be covered under their policy. However, in the event that the school or university policy does not respond or if the policy limits are exhausted due to a large loss, it is prudent to ensure that you have your own personal coverage available to protect your interests.

Who is Eligible?

All W2 employees of Schools, Colleges, and Universities are eligible.  Full and part time employees are eligible as long as your are a W2 employee and not an independent contractor.

When Does the Policy Begin?

Your coverage begins that day that your completed application and payment is received. Coverage will be effective for one year from that date and will automatically renew yearly unless you decide to cancel.

Examples of Recent Claims

Coverage A–Liability

A student climbing on a wire fence on school property fell, suffering severe cuts.  The teachers in charge of the students, as well as the principal of the school were sued for negligence.  The teachers and principal were covered and defended under the terms of the policy.

A student was being disruptive and using profane language.  The parents allege the student was subjected to excessive corporal punishment and inappropriate discipline, even though the discipline was handled according to the guidelines of the school district.  A lawsuit was filed alleging $2,000,000 in damages.  The case was settled for $400,000.

A student was killed in the school parking lot before school hours by a handgun shot.  The school administrators were sued for negligence.  The administrators’ educator policy responded to the suit and defended the members when the limits of the school district policy were exhausted.

Coverage B–Reimbursement of Attorney Fees for Criminal Proceedings

An insured was accused of indecent sexual conduct with three students during the school day.  A criminal investigation ensued and the member was subsequently exonerated.  The carrier reimbursed the member’s attorney for the full $35,000.

An insured was arrested and criminal charges were filed for assault of a student.  After the investigation was completed, the insured was found not guilty and the policy paid $21,000 to reimburse attorney fees.


Policy Coverage Overview

Coverage A: Professional Liability

Up to $1,000,000 per insured per occurrence and $3,000,000 per insured aggregate a year, plus the cost of defense, investigation and legal fees. Coverage applies to claims and allegations made against you within the scope of your employment duties.

Coverage B: Reimbursement Of Attorney Fees

Reimbursement of attorney fees incurred in the defense of a criminal proceeding, up to $35,000 per claim.

Coverage C: Reimbursement Of Attorney Fees As A Result Of Being A Victim Of Identity Theft

Up to $1,000 per policy period.

Coverage D: Bail Bonds

Up to $1,000 premium on bail bonds.

Coverage E: Assault Related Personal Property Damage

Reimbursement for damages or destruction of personal property if caused by an assault on or surrounding school property or while away from school property if on authorized school activity.

Coverage For School Nurses
  • First aid and nursing services performed by a school nurse or certified health aide
  • Physical therapy services rendered by a licensed physical or occupational therapist
  • Administration of oral prescription medicine to a student
  • Emergency first aid services rendered by an insured when a school nurse isn’t readily available
  • Psychological therapy or treatment rendered by a counselor
  • Health care services provided to students who are disabled within meaning of the Disabilities in Education Act or within Section 504 of the Rehabilitation Act of 1973
